Terms of Service

1. Service Description & Scope of Practice

Dt. Disha Dey is a Registered Dietitian and Clinical Nutritionist — not a medical doctor, physician, or psychiatrist. Services provided include personalised dietary assessment, nutrition planning, and dietary counselling.

Dietary advice, meal plans, and nutrition guidance provided by Dt. Disha Dey do not constitute:

• A medical diagnosis of any condition
• A prescription for medications or supplements
• Medical treatment for any disease or disorder
• A replacement for care by a licensed physician

Clients with active medical conditions — including but not limited to diabetes, thyroid disorders, cancer, kidney disease, cardiovascular disease, or eating disorders — must continue under the care of their treating physician. Nutrition counselling is provided as a complement to, not a substitute for, medical treatment.

2. Not a Medical Emergency Service

This service is not appropriate for medical emergencies. If you experience a health emergency — severe symptoms, chest pain, difficulty breathing, sudden significant weight changes, or any condition requiring immediate attention — contact your doctor immediately, call emergency services (112 in India), or go to the nearest hospital.

Do not use this service to seek emergency medical advice.

3. Client Responsibilities

By booking a consultation, you agree to:

• Provide accurate, complete, and current information about your health history, medical conditions, current medications, allergies, food preferences, and lifestyle
• Disclose all medications — including prescription drugs, over-the-counter medicines, supplements, and herbal remedies — that may interact with dietary recommendations
• Inform Dt. Disha Dey promptly of any changes to your health status, medications, or circumstances during the consultation period
• Follow the prescribed meal plan and report any adverse reactions immediately
• Consult your physician before adjusting medications based on dietary progress

Dt. Disha Dey is not liable for adverse outcomes arising from incomplete, inaccurate, or deliberately withheld health information.

4. Individual Results Disclaimer

Dietary outcomes — including weight loss, blood sugar control, hormonal balance, energy levels, or any other health metric — vary significantly between individuals based on genetics, adherence to the plan, pre-existing medical conditions, current medications, stress, sleep, and physical activity levels.

No specific result, outcome, or improvement is guaranteed. Testimonials on this website represent individual client experiences and do not guarantee similar results for any other person.

5. Professional Referral

If during consultation Dt. Disha Dey identifies signs or symptoms suggesting an undiagnosed or worsening medical condition, you will be referred to an appropriate medical professional. Dietary consultation may be paused until medical clearance is received. This is done entirely in your clinical interest and does not constitute abandonment of service or forfeiture of fees paid.

6. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Dt. Disha Dey's total liability for any claim arising from or related to these services is limited to the consultation fee paid for the specific engagement in which the claim arose.

Dt. Disha Dey shall not be liable for:

• Indirect, consequential, incidental, or punitive damages of any kind
• Health outcomes resulting from non-adherence to the prescribed diet plan
• Outcomes resulting from inaccurate or withheld information provided by the client
• Adverse reactions arising from undisclosed medications, allergies, or medical conditions
• Failures of third-party services (payment processors, WhatsApp, email providers, video platforms)

7. Health Data & Privacy Consent

Collection and processing of your personal data is governed by our Privacy Policy. Health and medical information is classified as sensitive personal data under India's Digital Personal Data Protection Act (DPDPA) 2023.

By proceeding with a consultation, you provide explicit consent for Dt. Disha Dey to collect, process, and securely store your health information solely for the purpose of providing clinical nutrition counselling. This data will not be shared with third parties except as described in the Privacy Policy.

You may withdraw consent at any time by contacting dietitiandisha@gmail.com. Withdrawal of consent will end the active consultation. Data will be retained only as required by applicable law (see Privacy Policy, Section 6).

8. Communication Consent

By booking a consultation, you consent to receiving consultation-related communications via WhatsApp and email. This includes booking confirmations, intake form links, diet plan delivery notifications, progress check-in reminders, and plan renewal reminders.

You may opt out of non-essential communications at any time by informing Dt. Disha Dey via WhatsApp or email. Opting out of essential clinical communications (e.g. plan delivery) may affect the quality of your consultation.

9. Fees, Refunds & Cancellations

• Discovery call: Free of charge. No payment, commitment, or obligation required.
• Consultation fees: Displayed on the Services section. All fees are in Indian Rupees (INR) and include applicable GST.
• Refund policy: Personalised diet plans are non-refundable once delivered. Each plan represents substantial clinical work tailored specifically to your health history and goals. If a plan has not yet been delivered, a refund request submitted within 48 hours of payment will be considered.
• Cancellations: Consultation call slots cancelled with less than 24 hours' notice may not be eligible for rescheduling without payment of a rebooking fee.
• Technical issues: If a scheduled call cannot proceed due to a technical failure on Dt. Disha Dey's end, the session will be rescheduled at no additional cost.

10. Intellectual Property

All meal plans, dietary protocols, guides, and written content created during or for your consultation are prepared specifically for your personal use. You may not reproduce, redistribute, publish, sell, or share these materials with third parties — in whole or in part — without the prior written consent of Dt. Disha Dey.

11. Governing Law & Dispute Resolution

These Terms are governed exclusively by the laws of the Republic of India. Any disputes arising from these terms or the services provided shall be subject to the jurisdiction of competent courts in India.

These terms are drafted in compliance with the Consumer Protection Act 2019, the Digital Personal Data Protection Act 2023, and applicable regulations governing dietary and nutrition advisory services in India.

12. Amendments

Dt. Disha Dey reserves the right to update or modify these terms at any time. Material changes will be communicated to active clients via WhatsApp prior to taking effect. Continued use of the service following notification of changes constitutes acceptance of the updated terms. The "last updated" date at the top of this page reflects the most recent revision.
